FERPA Compliance Statement
Family Educational Rights and Privacy Act
Our Commitment to Student Privacy
K12TeacherTools LLC is committed to protecting student educational records in compliance with the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. § 1232g. This statement outlines how we meet our obligations under FERPA in operating Wajibo.
What is FERPA?
FERPA is a federal law that protects the privacy of student education records. It gives parents/guardians certain rights with respect to their children’s education records, and these rights transfer to the student when they reach 18 or attend a school beyond high school.
How We Comply with FERPA
1. School Official Status
We function as a “school official” with legitimate educational interests. Schools that use our service maintain direct control over student data and grant us access only to perform our contracted educational services.
2. Limited Data Collection
We collect only the minimum student information necessary to provide educational services:
- Name (first and last)
- Email address (used to sign in)
- Learning progress and mastery results
- Class enrollment
We do NOT collect: Social Security numbers, home addresses, phone numbers, birth dates, or other sensitive personally identifiable information.
3. Use Restriction
Student data is used solely for educational purposes to:
- Enable study, review, and practice toward mastery
- Track learning progress
- Provide teachers with student performance insights
- Improve the educational effectiveness of our platform
Student data is NEVER used for marketing, advertising, or commercial purposes.
4. No Unauthorized Disclosure
We do not share, sell, rent, or transfer student personally identifiable information to third parties except:
- To the student’s teachers and school administrators
- To service providers (authentication, hosting, database) under strict confidentiality agreements that prohibit further disclosure
- As required by law or court order
- With explicit written consent from parents/guardians or eligible students
5. Data Security
We implement technical, administrative, and physical safeguards to protect student data:
- Encryption in transit (HTTPS/TLS)
- Authentication managed by Clerk, a SOC 2-compliant identity provider
- Secure database hosting with access controls
- Regular security reviews and updates
- Limited access on a need-to-know basis
6. Parental Rights
Parents/guardians and eligible students have the right to:
- Access: Request to review student education records
- Amend: Request correction of inaccurate information
- Consent: Control disclosure of personally identifiable information (except where FERPA allows without consent)
- Delete: Request deletion of student accounts and data
To exercise these rights, please contact your school or email us at support@k12teachertools.com.
7. Data Retention & Deletion
Student data is retained only as long as necessary to provide educational services. When a student account is deleted or a school terminates service, all associated student data is permanently deleted within 30 days, except where required by law to retain.
8. Breach Notification
In the event of a data breach involving student personally identifiable information, we will notify affected schools within 72 hours and provide details about the nature of the breach, affected data, and remediation steps taken.
School Responsibilities
Schools and teachers using Wajibo are responsible for:
- Obtaining necessary parental consent before enrolling students (if required by local policy)
- Maintaining the security of their own accounts and login credentials
- Notifying us promptly when students withdraw or should no longer have access
- Complying with their own institutional FERPA obligations
