Terms of Service

1. Agreement

Wajibo (“the Service”) is made by K12TeacherTools LLC (“we”, “us”). By using it — on the web, on iPhone or iPad, or on a Mac — you agree to these terms. If you do not agree, please do not use it.

2. What Wajibo is

Wajibo is a flashcard tool for building background knowledge to mastery. Learners study courses at their own pace. Teachers can make classes, write their own decks, and see how far each student has got.

3. Accounts

Three kinds

• Students whose teacher made their account sign in with the username and password their teacher gave them. The teacher manages the account and can reset or delete it.
• Learners who sign themselves up use Apple, Google or an email address, through our sign-in provider, Clerk.
• Teachers sign in the same way and turn on teaching from their account. Doing so, they confirm they are a K-12 educator.

Your responsibilities

• Keep your password to yourself, and tell us if someone else has used your account.
• One person per account.
• A teacher who creates student accounts is responsible for using Wajibo with student information in line with their school or district’s policies.
• A student may join a class with its class code; the teacher approves the request before the student is in the class.

4. Acceptable use

Please do not:

• Put anything into Wajibo — a deck, a class name, a display name — that is illegal, harassing, hateful, sexual, or otherwise unsuitable for a classroom.
• Impersonate someone, or misrepresent that you are a teacher.
• Try to get into accounts or data that are not yours.
• Upload malicious code, or interfere with the Service or its servers.
• Scrape or bulk-download the courses by automated means.

5. Content

The curated courses, the software, the design and the Wajibo name and bird belong to K12TeacherTools LLC. You may use them for your own learning and teaching.

Decks a teacher writes, and anything else you type into Wajibo, stay yours. You give us permission to store and show them only as needed to run the Service for you and your class.

Some course images, such as maps, are published by others under open licences and remain theirs.

6. Privacy

The Privacy Policy says exactly what we store, who can see it, and how to have it deleted. It is part of these terms.

7. Deleting and ending accounts

By you

If you made your own account, you can delete it from Settings, in the app or on the web. A teacher can delete a student, a class, or their own account from inside Wajibo. A student whose teacher made their account can ask the teacher, or write to us. Deletion is immediate and complete: the records are removed, not archived.

By us

We may suspend or close an account that breaks these terms or is used to harm others. We do not close accounts for being inactive.

8. No guarantee of results

Wajibo is a study tool. We cannot promise any particular grade, score or learning outcome, and it does not replace teaching.

9. Disclaimers and limitation of liability

Provided “as is”

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of liability

To the fullest extent the law allows, K12TeacherTools LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, use or goodwill, arising from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless K12TeacherTools LLC from claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising from your misuse of the Service, content you put into it, or your breach of these terms.

11. Changes

We may change the Service, or these terms. When the terms change we update this page and its date, and we tell teachers about significant changes by email. Continuing to use Wajibo after a change means you accept it.

12. Governing law

These terms are governed by the laws of the United States and of the state in which K12TeacherTools LLC is registered, without regard to conflict-of-law principles.
