Terms of Service

1. Acceptance of Terms

By accessing or using Wajibo (“the Service”), operated by K12TeacherTools LLC (“we,” “our,” or “us”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Wajibo is an educational platform offering flashcard courses that build to mastery, one unit at a time. Teachers can create classes, assign curated courses and lessons, and track student progress. Students study and review that material and build toward mastery at their own pace.

3. User Accounts

Account Registration

• Accounts are created and secured through our authentication provider, Clerk
• You must provide accurate, complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access
• One person per account (accounts may not be shared)

Teachers & Students

• Roles are contextual: you are a teacher of the classes you create and a student in the classes you join
• Students join a class using a join code provided by their teacher
• Teachers are responsible for ensuring proper permissions and consent for the students they enroll
• Accounts for children should be created with appropriate school or parental consent

4. Acceptable Use

You agree NOT to:

• Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation
• Upload viruses, malware, or any other harmful code
• Attempt to gain unauthorized access to the Service or other users’ accounts
• Scrape, copy, or download content in bulk using automated means
• Use the Service for any commercial purpose without our written permission
• Interfere with or disrupt the Service or servers
• Harass, bully, or harm other users

5. Content & Intellectual Property

The Service and its content — including the curated courses, software, design, text, graphics, and the Wajibo mascot and marks (excluding any content you submit) — are owned by K12TeacherTools LLC and protected by copyright and other intellectual property laws. You may use the content solely for your own teaching and learning within the Service.

Any names, class information, or other material you submit remains yours; by submitting it you grant us a limited license to store and display it as needed to operate the Service.

6. Educational Use Only

Wajibo is an educational tool designed to support learning. We make no guarantees about learning outcomes, grades, test scores, or academic performance. Use of the Service does not replace comprehensive study, teaching, or formal education.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. We comply with FERPA regulations regarding student data.

8. Account Termination

By You

You may delete your account at any time through your account settings or by contacting support. Upon deletion, your data will be permanently removed within 30 days.

By Us

We reserve the right to suspend or terminate accounts that:

• Violate these Terms of Service
• Engage in harmful or illegal activity
• Remain inactive for extended periods (with notice)

9. Disclaimers & Limitation of Liability

Service “As Is”

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the maximum extent permitted by law, K12TeacherTools LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless K12TeacherTools LLC from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from your use of the Service, your content, or your violation of these Terms.

11. Changes to Service & Terms

We reserve the right to modify or discontinue the Service (or any part thereof) at any time. We may also update these Terms from time to time. Significant changes will be communicated via email or in-app notice. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which K12TeacherTools LLC is registered, without regard to conflict of law principles.
